Vacation Accruals for Return-to-Work Retirees

Vacation leave accruals for return-to-work retirees are based on retirement and rehire dates. The table below provides examples of the different vacation leave accruals for return-to-work retirees who retired under the Teachers Retirement System of Texas or the Employees Retirement System of Texas on June 1, 2005 or later:

On or before 5/31/2005 Prior to 9/01/2005 Accruals based on total state service (no change) If the retiree retired 5/31/2005 and returned to work on 7/01/2005, his July, August, and September vacation accruals would use his total state service in the calculation just as before retirement.
On or before 5/31/2005 After 9/01/2005 Accruals based on total state service (no change) If the retiree retired 5/31/2005 and returned to work on 10/1/2005, his October vacation accrual would be based on total state service just as before retirement.
On or after 6/01/2005 Prior to 9/01/2005 Split accrual rates If the retiree retired 6/30/2005 and returned on 8/01/2005, his August accruals will be calculated on total state service, but his September accruals and thereafter will be calculated based on state service since 8/01/2005.
On or after 6/01/2005 After 9/01/2005 Accruals based on state service since retirement If the retiree retired 6/30/2005 and returned on 10/01/2005, his accruals for October and thereafter will be based on state service since 10/01/2005.

Return-to-Work Retirees

  • If you return to state employment after 30 calendar days and within 12 months after the end of your termination month, you may request to have your sick leave balance restored as long as it was not donated to the sick leave pool.
  • If the retirement date is on or after 6/1/2005 and the rehire date is after 9/1/2005 the accrual rate for vacation is based on state service since retirement.
    • For example, if a retiree retires on 12/31/2023 and returns to work on Feb 1, 2024 at 50% FTE in a staff position the vacation accrual will be 4 hours. for both sick and vacation. Holiday pay will also be 4 hours based on the 50% FTE.
    • Do not get Longevity payments.
  • Temporary/casual staff are not eligible for leave and do not get Holiday pay.
